Wintab Information
In 1999 an inventor sued our company claiming that the functionality of the Wintab API was covered by a patent the inventor was granted in 1998. One of our customers became involved in the litigation, and on October 16th 2001 the Federal District Court hearing the case ruled in our favor on several motions for summary judgment, finding non-infringement of claims 1-10, and invalidating the remaining claims 11-14 based on prior art.

Subsequently the inventor appealed the rulings on claims 1-10 and 13-14 and the Court of Appeals for the Federal Circuit vacated the lower court's decision and sent the case back for further hearings in 2002. Appeals Court Ruling

The litigation continued to grow, with a new lawsuit regarding another patent being added to the mix. Ultimately in 2004 we settled the litigation with the inventor and his company.

Pursuant to the terms of the settlement we are no longer offering licenses to our implementation of the Wintab API for digitizing tablets.
Avoiding Problems with the Patents
In order to avoid any possible use of the methods described in the patents we encourage all developers of tablet based applications to carefully review their code to ensure that it does not use any of the claimed methods.
